The disabled face many challenges, not the least of which is access to affordable health care. Those who carry private insurance or Medicare have part of that problem solved. Those that do not, usually turn to Medicaid. And, almost everyone is at risk for long-term nursing care since neither traditional private health insurance nor Medicare cover nursing homes. Access to Medicaid is based on strict financial criteria. Special Needs Trusts are a way to create a “safe harbor” for assets when Medicaid is required.
